Resumo: This study provides an in-depth analysis of the Brazilian prison system, with special emphasis on the condition of foreign inmates. The research investigates whether Brazilian prison practices are in line with the functions of punishment - to punish, prevent, and rehabilitate - particularly from a human rights perspective. Current penal policies, discrimination, and the challenges faced by foreign prisoners, such as language barriers and lack of proper legal assistance, are examined. The evolution of Brazilian legislation and jurisprudence is also explored, with a focus on the Migration Law of 2017, which signifies a significant step forward in protecting the rights of foreigners. The Itaí Penitentiary is highlighted as a positive example of efforts to improve the treatment of these prisoners, underscoring the importance of policies that promote respect and social reintegration. The study concludes by emphasizing the need for ongoing development of policies and practices that ensure equal treatment and respect for the rights of all prisoners, aiming for more equitable and effective justice
