The present study has as its object the study, from a doctrinal and jurisprudential research, to describe about the provisional tutelages in the new Brazilian Civil Procedure Code. As for the structure of work, it is divided into five chapters. I will first address the historical evolution of the provisional guardianship, since in the revoked code of 1973, provisional guardianships were not first foreseen and later this was foreseen, still in force of this one. Then I will address the provisional guardianship in the 2015 code, explaining their differences and procedures. Finally, I will discuss the stabilization of early guardianship, now foreseen in article 304 of the new civil procedure code. The purpose of this work is, with the support in doctrine, to bring dissolutions to the doubts that arise from all these changes. It seeks to construct the dynamics of all the necessary procedure to explain the importance and complex matter of provisional protection, since it is often a question of anticipating the author's request, even before the defendant is heard
