This working conclusion of the Graduate course in Civil Procedure at the Catholic University of São Paulo is focused on the institute of Absentia, Article 320 of the Civil Procedure Code. This institute has great importance for the modern civil process, given that serves as a sanction mechanism for that defendant who has no interest to participate in the proceedings, not intervening in the procedural relationships. Roman base the institute has evolved along with the civil procedural law, going far beyond a defendant's coercion to attend the proceedings, as a true guarantee for procedural to the author. Today the smooth progress of procedural motion is necessary for the parties to attend the proceedings. And no show can not do with the process stops, and the Institute of great importance to the procedural default progress and solution of the dispute, given the presumption of truthfulness of the facts alleged by the author and not disputed by the defendant
