The following work of post-graduation is about the delegation of public sanitation services, seeking to explain by which means the state ensure the provision of public sanitation services essential to health and dignity of the human person. To fulfill this mission, we devoted to the analysis of historical evolution of the provision of public sanitation services in Brazil, focusing on the forms of state actions in the provision of such services to the citizens. Then we move to the analysis of the concept of public service, addressing the requirements and modalities of total or partial delegation of public sanitation services, predicted in federal constitution and in infraconstitutional laws in force. Finally, we studied the innovations brought by federal law number 11.445, of January 5 of 2007, regarding the additional requirements to be observed by public administration in order to delegate public sanitation services
