Resumo: This paper is a critical analysis of the role of the Judiciary System and its interpreter in a Democratic State, mainly when, under the justification of the satisfaction of constitucional principles and the resolution of social demands not appreciated by the Executive and Legislative Systems, the Judiciary System ends up imposing itself and diminishing the sphere of influence of those powers, causing, in result, Judicial activism, besides legal insecurity, from its active stance. On this subject, the adopted research methodology was a literature review of texts by jusphilosophers, in addition to the analysis of concrete cases, addressing mainly the “Kelsenian challenge”, in order to comprehend not only the consequences of a active and expansionist stance by the Judiciary System, but also what, historically, gave rise to such modus operandi, besides trying to understand and delimit what is the role of the jurist in a Democratic State
