In thiswork theobjectofanalysisisthe“embargos de declaração”, starting with the origin, historical evolution and current configuration of this institute, which juridical nature still raises different opinions from the doctrine homeland.In addition, the study will include the analysis ofseveral effects ofthe “embargos de declaração”, with special focus on amending or infringing purposes, which will be addressed under the umbrella of each of the hypotheses of the appropriateness ofthe “embargos de declaração”, given the understanding ofdoctrine and the more recent decisions of the Superior Court.Furthermore, with regard to the amending or infringing purposes of the “embargos de declaração”also will be addressed the necessity of complying or not the Principle of Contradiction, and the admissibility of "reformatio in pejus".Moreover, some consideration will also be undertaken on the Draft Legislative Senate nº166/2010 establishing thenew Code of Civil Procedure thatbrings relevant changes in relation to various procedural mechanisms,includingthe “embargos de declaração”.Finally, it will be woven reasonable conclusions on the subjectstudied
