Resumo: The scope of this dissertation is to analyze the position occupied by the judge in face of procedural legal business in the current system of the Code of Civil Procedure of 2015, which encourages the dialogue between the subjects of the procedural relationship; the autonomy of will; and cooperation. The structure of this sicentific work is divided into three chapters. The first chapter deals with legal business in the sphere of civil law and, also, in the theory of the procedural legal fact. The second chapter brings the concept of procedural legal business, its historical evolution, classification and discusses the general and specific conditions of validity applied to procedural legal business. Finally, the third chapter is dedicated to presenting the judge's role in procedural legal business, delimiting his powers and appeals against his decision

No tocante à estrutura, o trabalho se divide em três capítulos. O primeiro capítulo aborda o negócio jurídico na esfera da lei material civil e, também, na teoria do fato jurídico processual.
