Resumo: This monograph proposes to analyze the freedom of expression and the hate speech addressed to immigrants. To achieve this purpose, the work begins with the determination about what is freedom of expression, passing through the other freedoms linked to it, freedom of thought, opinion, artistic, religious, information and press and assembly, finally reaching the hate speech against immigrants in order to analyze the fine line that exists between the two points, analyzing the differences between the American legal system and the Brazilian system. In order to comply with the proposal, the Federal Constitution of 1988 and two international human rights treaties that Brazil is a part of, the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, doctrine, historical facts, statistics and American law in order to make a comparison; The analysis focus on the moment in which the morally reprehensible speech ends and the moment that the hate speech begins, the difference between saying something and committing a crime. In its conclusion, the paper seeks to establish the limits that freedom of expression possesses, considering the situation of the immigrant in national territory and around the world

Para atingir esse propósito por completo, o trabalho começa com a determinação sobre o que é liberdade de expressão, passando pelas outras liberdades atreladas a ela, a liberdade de pensamento, de opinião, artística, religiosa, de informação e de imprensa e de reunião, chegando ao discurso de ódio contra o imigrante de forma a analisar a linha tênue que existe entre os dois pontos, fazendo uso de uma comparação entre o direito Brasileiro e o estadunidense. A fim de conseguir cumprir o proposto, são usadas como base a Constituição Federal de 1988 e dois tratados internacionais de Direitos Humanos que o Brasil faz parte, a Declaração Universal de Direitos Humanos e o Pacto Internacional de Direitos Civis e Políticos, doutrina, fatos históricos, estatísticas e o direito norte-americano; sendo analisado o momento em que termina o discurso moralmente reprovável e em que momento começa o discurso de ódio, a diferença entre dizer algo e cometer um crime.
