The purpose of this work is to study the non-competition clause and its application in labor individual contracts, agreement that has become very common in the labor market, due to the advent of globalization and the consequent need for companies to protect their secrets. Objectively, explains the concept of non-competitive agreement, its evolution and scope in national legislation. The validity or not of non-competition clause is a very controversial issue because it puts in opposition employer's rights (protection of company secrets) to workers' rights (free exercise of the work). Moreover, because this agreement is not expressly provided in the Brazilian legal system, seeks to analyze their applicability through constitutional, labor and contractual principles, through comparative law and in the best interests of the parties. Finally, it is studied the embodiment of non-competitive contract and its requirement to be considered valid
