Arbitragem e o novo Código de Processo Civil: direito processual civil

Resumo: Great part of the problems and conflicts that happen in ours society, when it is not resolved in agreement of both, become resolved by the Judiciary Branch. However, we know that the Judicial Branch resolves conflicts with delay. According to the association of Brazil's magistrates, we have a new proccess in each 5 (five) seconds. Because of that, the means of alternative dispute resolution are being preferred, among this the arbitration. The arbitration is one of the alternative means, heterocompositive, extra judicial and necessarily voluntary, when the parts, any individual or legal entity, can resolve a dispute within the scope of the property rights available, reaching a favorable consensus to both, without the tutelary need of the Judicial Branch

Porém, sabemos que o Poder Judiciário possui uma morosidade excessiva para resolução dos conflitos. Segundo a Associação de Magistrados no Brasil, temos um novo processo a cada 5 (cinco) segundos. Por este motivo, os meios de resolução de conflitos alternativos vêm ganhando destaque, dentre eles, a arbitragem.
