Resumo: | This paper aims to discuss the viability to apply the preliminary injunction stabilization procedure when the injunction is required against the State. Therefore it is going to be traced a prospect of the approach adopted by the new Civil Process Code to the different kinds of injunction, which began to treated under the same chapter, as preliminary injunctions. The stabilization of the preliminary injunction is an innovation in the brazilian law made into legislation by the new Civil Process Code. Nevertheless, the theme is not unknown to brazilian authors that studied it through the foreign law . In order to evaluete the legality of the application of this new procedure againt the State it is necessary to define the real meaning of the stabilization and its consequences, passing through the study of the res judicata and the mandatory appeal, besides the potential need to observe any verdict effectiveness requirement. Based on the analysis made in this paper it is safe to conclude that it is possible to apply the preliminary injunction stabilization procedure when the against the State and that it not necessary to observe the mandatory appel procedure as a verdict effectiveness requirement neither concerning the preliminary decision that grants the injuction nor the sentence that recognizes the stabilization |

Para tanto será traçado um panorama da abordagem da tutela cautelar e antecipada no Novo Código de Processo Civil, que passou a tratar ambos os institutos sob um mesmo capítulo, o da tutela provisória. A estabilização da tutela provisória constitui inovação no direito pátrio positivado pelo Novo Código de Processo Civil. Contudo, seu estudo pelos doutrinadores Brasileiros teve início em momento anterior em razão da previsão já existir em outros ordenamentos jurídicos. Com a finalidade de discutir o cabimento deste novo procedimento em face da Fazenda Pública se demonstra necessário avaliar o significado da estabilização e as suas conseqüências, passando-se pelo estudo da coisa julgada e do reexame necessário, além da eventual necessidade de observação de algum requisito de eficácia da decisão.
