Estratégias de enfrentamento utilizadas por jovens não reincidentes em atos infracionais no Centro-Oeste brasileiro

Resumo: | The study of the early encounter of developing individuals with the Justice is necessary in view of the growing increase in the indexes of young people directed to the fulfillment of Socio-educational Measures from North to South of the country, in addition to the widespread recidivism of misdemeanor each year. The present research proposed to listen and record the narrative of 12 (twelve) subjects who reached the legal age of majority, having fulfilled, during adolescence, some type of socio-educational measure for non-compliance with the laws and decided to choose paths that would distance them from the contravention in a medium-sized city of the Brazilian Midwest. The reports contained in the work bring generative information that can help the building of projects to support the most positive choices made by these and other young people, helping them to tread more fulfilling paths in their lives. Social constructionism and the teachings of narrative therapy provided the methodological paths through which we sought to identify significant elements that participants suggested as important for making their decisions, considering the influence of the sociocultural and family contexts on them. We had a lot of difficulty in getting in touch with possible research participants; as they should have been away from problems with the justice for at least three years, there was no up-to-date information about them, since the responsible institutions only have data on those who, at the time, were part of the enforcement process. Therefore, such disconnection from institutions prevented easy access to them. The results showed the need to expand educational projects that can include this contingent of young people who leave schools early and enter the judicial environment and who, once the measures have been complied with, disappear from the archives if they do not recur. Another important point noted was the lack of dialogue and integration between the institutions involved in the socio-educational processes, which should provide a contemporary way of seeing and living with these young people. In this way, the study pointed out a necessary opening of works that bring the institutions involved in the socio-education process together and that can adequately meet the demand of young people who enter the judicial system, expanding innovative services, which already exist in small numbers, such as Restorative Justice and the Advancement of the Young Apprentice. Our experience with the research has shown that, despite attempts to modernize institutional justice and education, our city will have to offer a greater volume of assistance, as well as follow-up that includes post-measures, to provide effective support for our youth taking decisions |

A presente pesquisa se propôs a ouvir e registrar a narrativa de 12 sujeitos que atingiram a maioridade legal, tendo cumprido, durante a adolescência, algum tipo de medida socioeducativa por descumprimento das leis e decidiram optar por caminhos que os afastassem da contravenção em uma cidade de porte médio do Centro Oeste brasileiro. Os relatos contidos no trabalho trazem consigo informações generativas que podem auxiliar a construção de projetos que apoiem as escolhas mais positivas por esses e outros jovens ajudando-os a trilhar caminhos mais realizadores em suas vidas. O construcionismo social e os ensinamentos da terapia narrativa forneceram os caminhos metodológicos pelos quais buscamos identificar elementos significativos que os participantes sugeriram como importantes para tomarem suas decisões levando em conta a influência do contexto sociocultural e familiar sobre eles. Tivemos bastante dificuldade em obter o contato dos possíveis participantes da pesquisa; como deveriam estar afastados de problemas com a justiça por pelo menos três anos, não havia informações atualizadas sobre eles, uma vez que as instituições responsáveis apenas possuem dados daqueles que, no momento, faziam parte dos processos de cumprimento de medidas. Portanto, tal desligamento das instituições impediu o fácil acesso a eles. Os resultados mostraram a necessidade de ampliação de projetos educativos que possam incluir esse contingente de jovens que deixam precocemente as escolas enveredando pelo ambiente judicial e que uma vez cumpridas as medidas, somem dos arquivos se não reincidirem. Outro ponto importante constatado foi a falta de diálogo e integração entre as instituições envolvidas nos processos socioeducativos, os quais deveriam conferir contemporaneidade na forma de ver e conviver com esses jovens. Dessa forma, o estudo apontou uma necessária abertura de trabalhos que aproximem as instituições envolvidas no processo da socioeducação e que possam atender adequadamente a demanda de jovens que ingressam no sistema judicial, ampliando serviços inovadores, que já existem em pequeno número, a exemplo da Justiça Restaurativa e o Avanço do Jovem Aprendiz (AJA).
