The present study aims to examine the legal implications of the therapeutic use of embryonic stem cells, comparing the express permission of Art. 5 of the Law on Biosafety, which authorizes, for purposes of research and therapy, the use of such cells obtained from human embryos produced by in vitro fertilization and not used in their procedure, provided that it is non-viable embryos, or embryos frozen three years ago, it is imperative to authorization of the parents. To this end, we adopted a search of a socio legal and based on the literature review, looking at the doctrine, legislation and legal elements for addressing the research problem. It was concluded at the end, that art. 5 of the Law on Biosafety, rather than hurt the right to life and human dignity, to ensure that these rights are extended to a larger number of people, to the extent that the results of research he allowed, can modify the quality of life of people who can not live it to its fullest, and who see in these surveys a chance to enjoy this right in a dignified manner
