Resumo: The modern world is undoubtedly marked by the use of social media, responsible for being the primary means of information sharing. Concurrently, there is the popularization of so-called Fake News, inserted in a context of 'post-truth.' This present work aims to provide a careful legal perspective on this entire reality and the resulting consequences, such as the relativization of truth, the supremacy of subjectivism, and the disregard for the objectivity of facts, all acting as agents contributing to the current decline of democratic values. Using this as a starting point, it is necessary to understand the outlines of the right to information and its effectiveness, being the presupposition for the realization of so many other rights. Moreover, it is more than that; we must question whether the right to information holds any meaning if there is no assessment of the quality of the guaranteed information

Concomitante a isso tem-se a popularização das chamadas Fake News, inseridas em um contexto de “pós-verdade”. O presente trabalho busca trazer um olhar jurídico cuidadoso a toda essa realidade e as consequências que se apresentam, tais como a relativização da verdade, a supremacia do subjetivismo e o desapreço para a objetividade dos fatos, todos como agentes para o presente declínio dos valores democráticos. Usando isso como ponto de partida, é preciso compreender os contornos do direito à informação e sua efetividade, sendo este o pressuposto para a concretude de tantos outros direitos.
