Introduction: Affective parental abandonment originates from negligent conduct practiced byan individual with the legal duty to provide emotional, moral and social assistance to another.In filial relationships, the legal system establishes legal and reciprocal duties between parentsand descendants, such as the obligation of care and moral assistance. Objective: This paperaims to analyze the possibility of applying the institute of civil liability in cases of affectiveparental abandonment. The theme was chosen due to the high occurrence of this phenomenonin the country, the inexistence of a consolidated understanding in the legal system, withdecisions, even from the same courts, diverging on the theme and the progress of bills thatintend to include this possibility in the positive law, namely the Bill of Law nº 4.294-A of 2008and the Bill of Law of the Federal Senate nº 700/2007. Material and Methods: Based ondescriptive and explanatory research and the application of the bibliographical researchmethod, the current legal system, the court decisions on the matter, and the bills that intend tointegrate the legal system were analyzed. Result: The study confirmed the viability of holdingthose who committed such unlawful conduct civilly liable due to the legal previsions presentin the current legal system and the moral damages caused by this omission. Therefore, the lawprojects are not necessary conditions to allow the victims of affective parental abandonment tobe compensated; however, the proposals allow to annihilate the uncertainties about the theme
