The present work aims to address religious racism in the current Brazilian scenario, the result of a country with slavery roots and, consequently, racist, with the majority of its population being black or with African roots. However, it aims to expose religious intolerance in a constitutionally secular State and, in return, repress the religious and cultural manifestations of black people through the criminalization of their rites. In this sense, I approach the legal point of view regarding the structural racism present in society and its reflections in the religious sphere, pointing out the guarantees of collective cultural rights and the human essence of each of them. Furthermore, throughout the work I will address the virtue of ancestral knowledge within Afrocentricity and how African religious groups were organized since the first steps of slaveholding Brazil. Finally, I addressed the role of the State in combating racism and, consequently, religious racism, through the adoption of public measures and policies aimed at not perpetuating religious racism and its consequences
