Resumo: The present assignment approaches the application of the concept of fraud against enforcement of court decisions and collective documents, in particular the effects arisen by the selling of the assets subject to fraud. The study traces a brief historical background from Roman Law in a practical and evolutionary way towards the Brazilian Code of Civil Procedure of 2015, demonstrating the evolution of the institute, the jurisprudential understanding, especially that from the Superior Court of Justice with the advent of Precedent No. 375, in addition to the provisions contained in the Codes of Civil Procedure and extravagant law. In this context, it is intended to briefly and concisely address the application of fraud against enforcement of court decisions and collective documents and its effects in relation to the third-party that acquires the related assets
