Resumo: This study analyzes the hypotheses of implementation of fraud, especially under the new Civil Procedure Code. To do so, the institute will be examined from various aspects, emphasizing the most controversial issues, which are revealed by different interpretations formed in doctrine and Superior Court of Justice’s jurisprudence, seeking to resolve doubts about theorical and practical aspects. Although it has been around for much in Brazilian system, debate is still current because represents an important instrument for creditors’ benefit. After all, in final perspective, it is a mechanism to guarantee the procedural effectiveness, which is limited by third person’s interests
