The Brazilian Law n. 13.129 /2015, which promoted the real reform of Brazilian Arbitration Law n. 9.307/1996, among the changes introduced in rights by arbitration, we can say that the most relevant of these is that provided for in § 1st of article 1, which has been granted indistinctly the use by the, allowing public entities, of the arbitration route to resolve disputes regarding available property rights, thus allowing the insertion of arbitration clauses in administrative contracts in general, and the institute was foreseen until then only in some sparse Laws of our national legal system. This monograph aims at exploring the main aspects of arbitration within the Public Administration, an alternative method of conflict resolution already established as a practice in Private Law, bringing to a better understanding the above mentioned rule a historical, doctrinal and jurisprudential, exploring factual approach in order to promote the use of the arbitration procedure in conflicts involving the Public Power
