The Supreme Court judge to direct actions of unconstitutionality used only conventional techniques considered judgment, namely, the declaration of constitutionality and the declaration of unconstitutionality, which therefore entailed the annulment of the law or normative act challenged. However, the use of these techniques did not consider the effects that the challenged laws had produced during its lifetime. Thus, not only the Supreme Court, but other courts, inspired by German law as a way to reconcile the technical trial with its effects on the factual world, began to make use of alternative techniques of decision for the trial of direct actions unconstitutional, modulating its effects, in order to preserve legal certainty and exceptional social interest. In Brazil, only in the year 1999, with the enactment of Law No. 9868, the technical decision alternatives were expressly provided for in the Brazilian legal
