Resumo: The present essay aims to analize and clarify how the adversarial principle is observed under the scope of the Incident of Resolution of Repetitive Demands, assuming that, in the incident, the bipolar structure developed around the dispute does not exist. For that, reference is made to the critical approach regarding the effects of the decision issued in the context of the incident before the parties from the staying proceedings and how the parties from the incident contribute for the final decision. Thus, by means of a doctrinal legal research the present essay aims to answer questions about this issue, suggesting that the adversarial right is exercised on a different perspective, bearing in mind it is not taken by its traditional concept

Para tanto, tem-se como referência a abordagem crítica a respeito dos efeitos da decisão proferida no âmbito do incidente perante as partes dos processos sobrestados e de que forma os sujeitos processuais do incidente contribuem para a formação de tal decisão.
