This Academic Work aims to study the relation between judicial precedents, here meaning, broadly, according to the new system of the Civil Procedure Code of 2015, judgments, precedents and binding theses, and arbitration jurisdiction. In the work, whose research method was the review of doctrine and jurisprudence, are presented the common and civil law systems and the evolution of the precedent system. Subsequently, the arbitration system is discussed (from the perspective of the Brazilian legal system), making considerations about the issue under focus: the relation between judicial precedents and arbitration (especially that of law, with the choice and application of Brazilian law), highlighting the doctrinal divergence, as well as arguments of the currents contrary to the conclusion reached, and it is also presented a proposition to remedy, at least until a later moment, the legal uncertainty that the lack of definition can lead to
