With the advancement of society, man sought ways to move around and transport items of his interest in an agile, safe and uncomplicated way. After World War II, motor vehicles created strength in the follow-up of cargo transportation, generating the need for regulation of the service. In Brazil, Law no. 11.442/2007 regularized the activity of the freight forwarder, guaranteeing the hiring of the provider without recognition of employment, determining the incompetence of the labor courts to analyze the contract. In practice, this hiring is not so simple, there is a great legal discussion about the limits of this legislation, and the need for probative analysis to ensure the applicability of the principle of primacy of reality, which overlaps with any written contract. This situation led to the distribution of numerous labor claims, and the necessary protection of the occupation was not present. Currently, we are experiencing a situation of suspension of actions that deal with the applicability of Law no. 11.442/2007, demonstrating the inevitability of providing a legal guarantee of the activity, both for contractors and for contractors
