The present work intends to analyse how the new civil procedural legislation affected the arbitration proceedings within the Brazilian legal context. At the outset, a brief introduction to the new procedural legislation and its highly constitutional and principled bias was presented, leading to the encouragement of conflict resolution by friendly and extrajudicial means, increasingly distancing itself from the need for decision by a toiled judge. It also took care to analyse the different methods of alternative dispute resolution, with special focus on the arbitration procedure before and after the beginning of the new Code, seeking to observe how it influenced the arbitration procedures. Finally, the paper analyses the aspects brought by the new law, observing the nuances of the arbitration procedure after the advent of the new civil procedural legislation, observing the extent of the impacts caused and if positive for the arbitration institute
