Resumo: This dissertation aims to demonstrate that the computer programs protection, a tertium genus in the Brazilian contemporary law, requires an updated comprehension from the Property Principle and its function, so that the legal system of software can be adapted to social, economic, and technological needs. The Protection of Property Principle functionality, as a fundamental right, acting as an optimizer of the legal system of software, promotes wealth distribution. This study demonstrates that hermeneutics, on the premise of transdisciplinary understanding, may contribute to the legal system of the software adaptation to the Brazilian Constitution.

A funcionalidade do instituto da tutela da propriedade, como um direito fundamental, ao atuar como otimizadora do sistema jurídico de software, promove a distribuição de riquezas.
