This dissertation, based on an interdisciplinary study, search the thematic analysis of the act filicide, especially the one practiced only by the parent, as well as the penal framework (infanticide or homicide) given to the agent, their motivation and the legal and medical to be adopted. Initially, we sought to determine the criminal justice environment because the woman who threatens the life of your child, addressing the history, quirks and comparative law sees as the crime of infanticide (Article 123 of the Penal Code), illustrating the chapter with two real cases collected during the field survey, conducted in Forensic Psychiatric Institute Dr. Maurício Cardoso (IPF) in Porto Alegre (RS, Brazil). Immediately thereafter, pointed out how the target of our discussion and the puerperium puerperal state, issues of accountability and unaccountability of the agents who kill their children, and we made some considerations about the Article 26 of the Criminal Code and the so-called mentally ill. Under the interdisciplinary approach, we seek to address the safety precautions, their generalities, species, its fundamentals (culpability and dangerousness), pointing out the paradox between security measures and imprisonment itself, and the question of the indeterminacy of its period of duration, emphasizing the important contribution of high progressive regime.Then, we outline briefly the history of IPF, which we performed field research and through the specialized literature, sought to identify the pathologies found in the initial research, talking about each individual mental disorder (baby blues, postpartum depression , postpartum psychosis, bipolar disorder, schizophrenia and acute and transient psychotic disorder), which have affected the mother found filicide (08 cases in total), either before or after delivery. This time, this paper addresses the need for interdisciplinary study and better understanding to the prevention of crimes against the person, in specific, the one practiced by the mother against her own son, is due to the puerperal state or a psychiatric disorder prior or later in pregnancy, this offense as complex and multifactorial that deserves greater attention in the fields of academic research criminological or psychiatric.
