Resumo: This thesis intends to understand how the judges of the State of Rio Grande do Sul apply the privilege represented in art. 33, paragraph 4 of Law 11.343/06, which constitutes the conduct of privileged trafficking and provides for a possibility of reducing imprisonment from one-sixth to two-thirds. For this, an analysis was carried out of 420 judgments referring to appeals filed at the Court of Justice of the State of Rio Grande do Sul and filed regarding the application of the privilege, referring to the year 2019. Of these 420 judgments, 144 correspond to the First Criminal Chamber , 155 to the Second Chamber and 121 to the Third. The methodology adopted for assessing the data was mixed, so that both the quantitative and qualitative methods of analysis were used. Regarding the research problem, it questions whether second-degree judges would be repeating the behavior of first-degree judges, acting as mere cogs in drug trafficking incriminations - that is, acting in a punitive manner and denying the right to benefit from privilege –, or in the second instance there is a rupture of these actions of the magistrates. To answer this question, five chapters were developed. The first deals with formal drug control models, from prohibitionism to recent forms of regulation of marijuana markets. The second presents a case study of the regulatory model of recreational cannabis in Canada, carried out during the Sandwich Doctorate at the University of Ottawa. The third introduces the criminal drug policy in Brazil from four main axes of analysis: historical construction, current legislation, impacts and international perspective. The fourth chapter addresses trends in Brazilian criminal control in the post-democratization period and the fifth presents empirical data and results from the field. With the purpose of highlighting the performance of the justices, the following variables were analyzed in each judgment: defense, whether private or by public defender; gender of the defendant; type of crime committed; co-authorship; weapon, in case of apprehension; police witness; ostensive policing; variety of seized drug; drug volume; filing of the appeal; granting of the appeal; 1st degree decision, whether it was maintained or changed; relationship between first and second degree arrests; relationship between the regimes for serving first and second degree sentences; issuance of release permit; privilege, if it has been applied; why not, in case it has not been applied and the reasons. As main results, it was found that despite the legislation determining four conditions for the recognition of privileged trafficking - being the primary defendant, with a good record, not dedicated to criminal activities and not a member of a criminal organization - the judges of the First and Second Chambers did use of twenty-five extralegal reasons for not granting the benefit of the privilege, while the Third Chamber used only six. In this sense, from the analysis of the variables, it was evident that the Third Criminal Chamber differed from the other two Chambers studied, evidencing the existence of internal disputes in the studied legal field. This, while the Third Chamber presented judgments that were much more focused on a more guaranteeing understanding of the law and the Criminal Procedure, by adopting a posture of respect for the rights and guarantees of the defendants, granting most of the defense's appeals, while the other two Chambers acted in such a way as to reiterate very punitive behaviors in relation to the demands of those investigated and which, in most cases, did not respect the legislation and compliance with Due Process of Law.

Para ello, se realizó un análisis de 420 sentencias referentes a recursos interpuestos en el Tribunal de Justicia del Estado de Rio Grande do Sul e interpuestos sobre la aplicación del privilegio, referentes al año 2019. De esas 420 sentencias, 144 corresponden a la Primera Sala Penal, 155 a la Segunda Sala y 121 a la Tercera. La metodología adoptada para evaluar los datos fue mixta, por lo que se utilizaron métodos de análisis tanto cuantitativos como cualitativos. En cuanto al problema de investigación, se cuestiona si los jueces de segundo grado estarían repitiendo la conducta de los jueces de primer grado, actuando como meros engranajes en los delitos de narcotráfico –es decir, actuando de manera punitiva y negando el derecho a gozar del privilegio–, o en segunda instancia hay ruptura de estas actuaciones de los magistrados. Para responder a esta pregunta, se desarrollaron cinco capítulos. El primero aborda los modelos formales de control de drogas, desde el prohibicionismo hasta las formas recientes de regulación de los mercados de marihuana. El segundo presenta un estudio de caso del modelo regulatorio del cannabis recreativo en Canada, realizado durante el Doctorado Sandwich en la Universidad de Ottawa. El tercero introduce la política criminal de drogas en Brasil a partir de cuatro ejes principales de análisis: construcción histórica, legislación vigente, impactos y perspectiva internacional. El cuarto capítulo aborda las tendencias del control penal brasileño en el período posterior a la democratización y el quinto presenta datos empíricos y resultados de campo. Con el fin de resaltar la actuación de los magistrados, en cada sentencia se analizaron las siguientes variables: defensa, ya sea privada o por defensor público; sexo del acusado; tipo de delito cometido; coautoría; arma, en caso de aprehensión; testigo policial; vigilancia policial ostensiva; variedad de droga incautada; volumen de droga; interposición del recurso; concesión del recurso; Decisión de 1er grado, ya sea que se mantenga o se modifique; relación entre detenciones en primer y segundo grado; relación entre los regímenes para el cumplimiento de las penas de primer y segundo grado; emisión del permiso de liberación; privilegio, si se ha aplicado; por qué no, en caso de que no se haya aplicado y las razones. Como principales resultados se encontró que a pesar de que la legislación determina cuatro condiciones para el reconocimiento del tráfico privilegiado - ser imputado principal, con buenos antecedentes, no dedicado a actividades delictivas y no integrante de organización criminal - los jueces de Primera y la Segunda Sala hizo uso de veinticinco razones extrajudiciales para no conceder el beneficio de la parte privilegiante, mientras que la Tercera utilizó sólo seis. En este sentido, del análisis de las variables se evidenció que la Tercera Sala Penal se diferenciaba de las otras dos Salas estudiadas, evidenciando la existencia de conflictos internos en el ámbito jurídico estudiado. Esto, mientras que la Terceira presentó sentencias mucho más enfocadas a una comprensión más garantista de la ley y del Proceso Penal, al adoptar una postura de respeto a los derechos y garantías de los imputados, concediendo la mayor parte de los recursos de defensa, mientras que los otros dos Las Salas actuaron de tal forma que reiteraron conductas muy punitivas en relación con las demandas de los investigados y que, en la mayoría de los casos, no respetaron la legislación y el cumplimiento del Debido Proceso Legal.Esta tese pretende compreender de que maneira os desembargadores do estado do Rio Grande do Sul aplicam o benefício da privilegiadora representada no art. 33, §4ª, da Lei 11.343/06, que constitui a conduta do tráfico privilegiado e prevê uma possibilidade de redução de apenamento de um sexto a dois terços. Para isso, foi realizada a análise de 420 acórdãos referentes a recursos de apelação protocolados no Tribunal de Justiça do Estado do Rio Grande do Sul, interpostos com o fim de aplicação da privilegiadora, durante o ano de 2019. Desses 420 julgados, 144 correspondem à Primeira Câmara Criminal, 155 à Segunda Câmara e 121 à Terceira. A metodologia adotada para a apreciação dos dados foi mista, de modo que foram utilizados tanto o método quantitativo quanto o qualitativo de análise. Acerca do problema de pesquisa, questiona-se se estariam os julgadores de segundo grau repetindo os comportamentos dos julgadores de primeira instância, agindo como meros dentes de engrenagem nas incriminações por tráfico drogas – isto é, atuando de forma punitivista e negando o direito ao benefício da privilegiadora –, ou se, em segundo grau, existe uma ruptura dessas atuações dos magistrados. Para responder a essa questão, foram desenvolvidos cinco capítulos. O primeiro trata dos modelos formais de controle das drogas, desde o proibicionismo até as recentes formas de regulação dos mercados da maconha. O segundo apresenta um estudo de caso do modelo de regulação da cannabis recreativa no Canadá, realizado no decorrer de doutorado-sanduíche na Universidade de Ottawa. O terceiro introduz a política criminal de drogas no Brasil, a partir de quatro principais eixos de análise: construção histórica, legislação vigente, impactos e perspectiva internacional. O quarto capítulo aborda as tendências do controle criminal brasileiro no período pós-redemocratização. Por fim, o quinto capítulo apresenta os dados empíricos e os resultados provenientes do campo. Com a finalidade de evidenciar a atuação dos desembargadores, em cada acórdão, foram analisadas as seguintes variáveis: defesa (se particular ou por defensoria pública); sexo da parte ré; tipo de crime cometido; coautoria; arma (em caso de apreensão); testemunha policial; policiamento ostensivo; variedade da droga apreendida; volume de droga; interposição do recurso de apelação; provimento do recurso de apelação; decisão de primeiro grau (se foi mantida ou alterada); relação entre apenamentos de primeiro e segundo grau; relação entre os regimes para cumprimento de pena de primeiro e segundo grau; expedição de alvará de soltura; privilegiadora (caso tenha sido aplicada); e os motivos da não aplicação da privilegiadora (se tiver sido o caso). Como principais resultados, apurou-se que, não obstante a legislação determine quatro condicionantes para o reconhecimento do tráfico privilegiado – ser o réu primário, com bons antecedentes, não dedicado a atividades criminosas, nem integrante de organização criminal –, os desembargadores da Primeira e Segunda Câmaras fizeram uso de 25 motivos extralegais para não deferir o benefício à privilegiadora, enquanto a Terceira utilizou apenas seis. Nesse sentido, a partir da análise das variáveis, ficou evidenciado que a Terceira Câmara Criminal destoou das outras duas câmaras estudadas, mostrando a existência de disputas internas no campo jurídico estudado. This, while the Third Chamber presented judgments that were much more focused on a more guaranteeing understanding of the law and the Criminal Procedure, by adopting a posture of respect for the rights and guarantees of the defendants, granting most of the defense's appeals, while the other two Chambers acted in such a way as to reiterate very punitive behaviors in relation to the demands of those investigated and which, in most cases, did not respect the legislation and compliance with Due Process of Law.
