Resumo: Brazilian reality still affected by the dehumanizing transatlantic transportation of slaves and by the long-term enslavement; which were not succeeded by a transitional justice process. Racial phenomena, especially racism, have generated individual and collective losses. They are the cause or the cause connexions of not fully developing the potential, violence occurrence, denial of opportunities, and the resistance to behavioural change. Public policies and the legal framework are designed to consolidate rights, undo inequities, strengthen social cohesion and obstruct vicious cycles of reproduction of inequalities, constituting the ways in which the State is present. In the present thesis it is observed that issues pertaining to the black population do not reach the centrality of the national political agenda. Possible reasons for such a reality include stereotypes, racial prejudice, racism, and explicit and implicit biases that may compromise both personal and institutional judgments and decision-making. Thus, it is investigated whether the ant discriminatory public policies of racial character and the Universalists could use only coercive methods or also of nudges. Behavioural public policies could be more effective than nudges by compelling them to adopt more appropriate behaviours. Discrimination, seen as a dynamic process that works over time in different ways in different domains, requires that public policy actors pay attention to intergenerationality, as well as the possibility that disadvantages are transmuted from one domain to another. other. It is important to pay special attention to the fact that the routinizations and simplifications that are carried out by street-level bureaucrats can be confused with prejudice and bias, eventually generating differentiated treatments for part of the population. The contributions of the thesis are to estimate how the legal framework and public policies related to racial inequalities or the racial cuts of universalist policies affect social domains, as well as to suggest changes in the legal framework, public policies and institutional structures. With the establishment of the inferred impact level, it becomes possible to infer the potential impact and the generated impact in each highlighted domain.. The main contribution of the thesis is to estimate how the legal framework and public policies regarding racial inequalities, or the racial cutbacks of Universalist policies, affect the social domains. The thesis presents suggestions of changes in the legal framework, public policies and institutional structures. From the definition of the inferred impact level it is possible to infer the potential impact of the various instruments and the impact actually incurred on the domains. With this, it was possible to verify that, among the Constitutions, the one that generated the greatest impact was the Constitution of 1988. However, the impact was insufficient when compared to the potential of this instrument. With regard to adherence to international agreements, the Durban Conference produced the greatest impact. With regard to public policies, education is the one that causes the greatest positive impact, but at insufficient levels. Security, in turn, has a negative impact. Based on this analysis, proposals and recommendations for changes in the legal framework and in public policies are offered.

Les phénomènes raciaux, en particulier le racisme, ont généré des prejudices individuels et collectifs. Ils sont la cause ou plusieurs causes de ne pas être pleinement développés les potentiels tels que la violence, le déni des oportunités et de résistance aux changements des comportements. Les politiques publiques et le cadre juridique ont pour but de consolider les droits, de supprimer les iniquités, de renforcer la cohésion sociale et de faire obstacle aux cycles vicieux de reproduction des inégalités, constituant ainsi la manière dont l’État est présent. Dans la présente thèse, il est observé que les questions relatives à la population noire n'atteignent pas la centralité de l'agenda politique nationale.Les raisons possibles concernant cette réalité y compris les stéréotypes, les préjugés raciaux, le racisme et encore des biais explicites et implicites sont susceptibles de compromettre les jugements et les prises de décisions autant personnelles qu’institutionnelles. C'est pourquoi on cherche à savoir si les politiques publiques antidiscriminatoires à caractère racial aussi bien que les universalistes ne pourraient s’utiliser que des méthodes coercitives ou également des nudges.Les politiques publiques comportementales pourraient donc être plus efficaces que les nudges, en les incitant à adopter des comportements plus appropriés. La discrimination considérée comme un processus dynamique, fonctionnant au cours du temps de différentes manières, dans différents domaines, exige que les acteurs du secteur des politiques publiques soient attentifs à l’intergénérationnalité ainsi qu'à la possibilité que les inconvénients soient transmutés d'un domaine à l'autre. Il est important de faire attention particulière au fait que les routinisations et les simplifications effectuées par les bureaucrates du niveau de la rue pourraient se confondre avec les préjugés et leurs biais, ce qui conduirait à des traitements différenciés pour une partie de la population. Les contributions de la thèse consistent à estimer comment le cadre juridique et les politiques publiques concernant les inégalités raciales ou les approches raciaux des politiques universalistes affectent les domaines sociaux, ainsi que de suggérer des modifications du cadre juridique, des politiques publiques et des structures institutionnelles. À partir de la définition du niveau d’impact inféré, il est possible de déduire l’impact potentiel généré dans chaque domaine surligné. Grâce à cela, il était possible de mesurer que parmi les Constitutions, la Constitution de 1988 était celle qui produisait le plus grand impact. Cependant, l'impact était insuffisant si on le compare au potentiel de cet instrument. En ce qui concerne l’adhésion aux accords internationaux, la Conférence de Durban a produit le plus fort impact. À propos des politiques publiques, l’éducation est celle qui a le plus grand impact positif, mais à des niveaux insuffisants. La sécurité, à son tour, a un impact négatif. D’après cette analyse, des propositions et des recommandations sont offertes visant à modifier le cadre juridique et les politiques publiques.A realidade brasileira ainda é afetada pelo desumanizante transporte transatlântico de escravizados e pela longeva escravização, que não foram sucedidos por um processo de justiça de transição. Os fenômenos raciais, em especial o racismo, têm gerado prejuízos individuais e coletivos. Eles são causa ou concausa de não serem desenvolvidos potenciais de forma plena, da violência, da negação de oportunidades e de resistência à mudança comportamental. As políticas públicas e a estrutura jurídica são concebidas para consolidar direitos, desfazer iniquidades, fortalecer a coesão social e obstruir ciclos viciosos de reprodução de desigualdades, constituindo-se nas formas por meio das quais o Estado se faz presente. Na presente tese, é observado que as questões atinentes à população negra não atingem a centralidade da agenda política nacional. As razões possíveis para tal realidade incluem estereótipos, preconceito racial, racismo e vieses explícitos e implícitos que podem comprometer julgamentos e tomadas de decisão tanto pessoais quanto institucionais. Por esse motivo é investigado se as políticas públicas antidiscriminatórias de caráter racial e as universalistas poderiam se valer somente de métodos coercitivos ou também de nudges. As políticas públicas comportamentais poderiam ser mais eficientes do que os nudges por compelirem a adotar comportamentos mais adequados. A discriminação, vista como um processo dinâmico que funciona ao longo do tempo, de diversas maneiras e nos diferentes domínios, requer que os atores do campo das políticas públicas tenham atenção à intergeracionalidade, bem como à possibilidade de as desvantagens serem transmitidas de um domínio para outro. Importante ter atenção especial ao fato de as rotinizações e as simplificações que são realizadas pelos burocratas de nível de rua poderem ser confundidas com preconceitos e vieses, acabando por gerar tratamentos diferenciados para parte da população. As contribuições da tese estão em estimar como a estrutura jurídica e as políticas públicas relativas às desigualdades raciais ou os recortes raciais das políticas universalistas afetam os domínios sociais, bem como sugerir mudanças na estrutura jurídica, nas políticas públicas e nas estruturas institucionais. Com o estabelecimento do nível de impacto inferido, torna-se possível inferir o impacto potencial e o gerado em cada domínio destacado. Com isso, foi possível aferir que, dentre as Constituições, a que gerou maior impacto foi a Constituição de 1988. Contudo, o impacto foi insuficiente se comparado ao potencial desse instrumento. Em relação à adesão a acordos internacionais, a Conferência de Durban foi a que produziu o maior impacto. No que tange às políticas públicas, a educação é a que causa o maior impacto positivo, porém em níveis insuficientes. A segurança, por seu turno, impacta negativamente.
