Nesse sentido, dividiu-se o trabalho em duas partes, a primeira dedicada a analisar os aspectos políticos inerentes a justiça constitucional, bem como a função desempenhada pelo juiz constitucional na mesma. A segunda foi dedicada a realização da constituição e as designações do juiz constitucional enquanto interprete oficial e guardião do texto constitucional, abordando as problemáticas inerentes a este tema. Utilizando como fundamento a teoria formulada por Ronald Dworkin acerca da leitura moral da Constituição, justificou-se a legitimidade da efetuação do controle de constitucionalidade pela justiça constitucional, bem como uma interpretação extensiva do texto constitucional em virtude da defesa dos princípios constitucionais.Ademais, a referida teoria pode ser utilizada para justificar as razões pelas quais a vertente política inerente a norma fundamental influencia em todos os atos pertinentes a justiça constitucional. Dessa forma, a presente pesquisa visa contribuir para os ensinamentos doutrinários sobre o tema, bem como ser utilizada como uma forma de incitar novas reflexões e discussões sobre o tema, e ainda expor novas ideias acerca da realização constitucional.The present work aims to contribute to the analysis of the relationship between the juridical and political aspects inherent to constitutional law, especially in the scope of constitutional justice, in order to understand the political influence present in the actions of constitutional justice, that is, in the control of constitutionality and juridical-constitutional decisions, also investigating the role of the constitutional judge in the weighting between these two aspects. In this sense, the work was divided into two parts, the first dedicated to analyzing the political aspects inherent in constitutional justice, as well as the role played by the constitutional judge in the same. The second was dedicated to the realization of the constitution and the designations of the constitutional judge as an official interpreter and guardian of the constitutional text, addressing the issues inherent to this theme. Using Ronald Dworkin's theory of the moral reading of the Constitution as justification, the legitimacy of the constitutional justification for constitutional justice was justified, as well as an extensive interpretation of the constitutional text in virtue of the defense of constitutional principles.In addition, this theory can be used to justify the reasons why the political aspect inherent to the fundamental norm influences in all the pertinent acts the constitutional justice.
