The emergence and consolidation of the private military industry is intrinsically related to the profound political, economic, and conceptual transformations that took place nationally and internationally at the end of the twentieth century. With the end of the Cold War, the emergence of new types of private armies, with an entrepreneurial nature that marks the privatization of security, was seen. Private military companies can carry out functions that include: logistical support, non-lethal aid and assistance, strategic, operational and/or organizational analysis, tactical and strategic counseling, protection of facilities and personnel, training of military forces, and direct participation in combat operations. The present study reflects on the causes that led to the emergence of private military companies, evaluates the effectiveness of the current regulation of the sector, and argues about some of the legal implications associated with them, mainly the determination of the status of those and the attribution of responsibilities for violations of international humanitarian law and other aspects of the law. Thus, we analyze the difficulties of framing the activity of these new actors in the traditional parameters of legal regulation of those who take parte directly in conflicts
