Resumo: In this field of International Law, there have always been disagreements regarding the legitimacy to intervene in another State`s affairs, even if the State didn`t ask for help. This dissertation will analyze in-depth the most common critics regarding the Intervention Law, being the focus the legitimacy to do it. One of the main arguments against this law is that there might State`s that intervene under pretences to spread their political ideologies or religion on the other State. The interference in another State`s affair is a clear violation of their sovereignty. One of the main purposes of this dissertation is to analyze the arguments for and against humanitarian interventions and the specific motives for that. There are a significant number of authors that are in fact in favour, but, also a lot of them have stated that there have to be some criteria fulfilled before intervening. However, the time spent on checking the criteria, human lives may be endangered.

However, the time spent on checking the criteria, human lives may be endangered.Esta área do Direito Internacional desde sempre foi um motivo de discussões que acabam sempre pondo em questão qual será a derradeira legitimidade para se intervir noutro Estado, mesmo que o Governo do mesmo não tenha pedido ajuda. Nesta dissertação pretende-se analisar em profundidade as mais frequentes críticas relacionadas ao direito de ingerência, sendo o foco a legitimidade de intervenção. Um dos argumentos mais usados contra a legitimidade de intervenção, é que possivelmente alguns Estados usam deste direito para uma “invasão” legal como forma de expandirem e forçarem as suas ideologias políticas ou religiosas noutro Estado. Sem esquecer que intervir em assuntos de outro estado, é uma violação contra a sua soberania. Um dos principais objetivos desta dissertação é analisar os argumentos contra e a favor sobre as intervenções humanitárias e os seus motivos. Pode-se constar que um significante número de autores é a favor, contudo muitos deles impõem que certos requisitos sejam cumpridos antes que se parta para a ação.
