Resumo: This research study is part of the Master´s Degree in Law and Security – Nova School of Law at the Nova University in Lisbon, and aims to answer the following question: “Can the Republican National Guard assume itself as national coast guard?". The European Union created the European Border and Coast Guard by joining the Member States' coast guards to Frontex, strengthening the surveillance, control and supervision of the territorial sea and its external maritime border. Considering that Portugal doesn´t have a coast guard, we defined as the object of study the functional and territorial analysis of the Navy, the Maritime Police and the Republican National Guard (GNR), in order to confirm whether the GNR, as a Law Enforcement Agency with responsibilities in the maritime domain, has the capacity to assume itself as the national coast guard. To this end, we have defined the functions usually performed by coast guards, starting by analysing the genesis of the maritime service in Portugal and, subsequently, the framework of the coast guard functions. After this, we addressed the Maritime Authority System, which currently has powers of maritime authority, and moved on to describe the Navy, the Maritime Police and the GNR, analysing its legal framework, specific jurisdiction within the missions of surveillance, control and supervision of the territorial sea and the external maritime border. We, then, addressed some of the technological systems for surveillance and control of the coast, the territorial sea and the external maritime border, describing each of them and analysing their objective and capabilities. Finally, we concluded that the GNR has capabilities and competences that enables it to assume the role of national coast guard.

A União Europeia criou a Guarda Europeia de Fronteiras e Costeira juntando as guardas costeiras dos Estados-Membros à Frontex, reforçando a vigilância, o controlo e a fiscalização do mar territorial e da sua fronteira externa marítima. Considerando a inexistência de uma guarda costeira em Portugal, definimos como objeto de estudo a análise funcional e territorial da Marinha, da Polícia Marítima e da Guarda Nacional Republicana (GNR), por forma a confirmar se a GNR, enquanto força de serviço e segurança com atribuição no domínio marítimo, tem capacidade para se assumir como guarda costeira nacional. Para tal, definimos as funções normalmente desempenhadas pelas guardas costeiras, analisando numa primeira fase a génese do serviço marítimo em Portugal e, posteriormente, o enquadramento das funções de guarda costeira. Após este enquadramento, abordámos o Sistema de Autoridade Marítima, que exerce atualmente poderes de autoridade marítima, e avançámos para a caraterização da Marinha, da Polícia Marítima e da GNR, analisando o seu enquadramento legislativo, competências específicas no desempenho de missões de vigilância, controlo e fiscalização do mar territorial e da fronteira externa marítima. Para terminar, foram objeto de estudo alguns dos sistemas tecnológicos de vigilância e controlo da costa, do mar territorial e da fronteira externa marítima, fazendo a descrição de cada um deles e analisando o seu objetivo e as suas capacidades.
