Em Portugal, a reforma de lei de divórcio em 2008 deixou-nos uma pergunta: será que os danos decorrentes de uma violação de deveres conjugais são incluídos no art.º 1972? Maioria parte das doutrinas e jurisprudências assume uma posição afirmativa sobre o problema, mas também tem sido contestado por alguns autores.  Analisando argumentos das duas partes um a um e tentamos enquadrar aqueles deveres em categorias de responsabilidade civil, mas não obtivemos sucesso por existir dúvida em qualificação de natureza jurídica dos deveres conjugais, ou seja, não podemos afirmar que estes deveres sejam verdadeiros deveres jurídicos no contexto da atual lei de divórcio, por isso, a sua violação não pode causar a responsabilidade civil. Depois, tentamos analisar o problema na perspetiva da posição negatória e na perspetiva da posição responsabilizatória, concluímos que embora as posições dos dois difiram, na verdade, possuem o mesmo propósito, isto é, o procuro do indivíduo por mais garantia da personalidade no matrimónio. Por isso, reexaminamos a reforma em 2008, tentamos fazer uma interpretação do art.º1972 numa perspectiva contemporânea, acreditamos que essa reforma visa buscar um equilíbrio novo entre a liberdade e a garantia. No entanto, como vimos, para o alcanço desse equilíbrio é difícil. Portanto, mesmo que o direito não interfira nos assuntos íntimos, deve ajudar a parte fraca, pois que é o único caminho para esta parte poder melhorar a sua condição na relação conjugal, para poder negociar com o outro sobre a vida conjugal em posições iguais, para os seus interesses e os interesses dos fortes ser mesmo respeitados.Abstract Over time, several authors have shown a keen interest in whether the civil liability regime should be used to repair the damages caused by violations of marital duties. In Portugal, the divorce law reform in 2008 left us with a question: are damages resulting from a violation of marital duties included in article 1972? Most of the doctrines and jurisprudence takes an affirmative position on the problem, but it has also been contested by some authors. Analyzing arguments from both parties one by one, we tried to fit those duties into categories of civil liability, but we were unsuccessful because there is doubt in qualifying the legal nature of marital duties, that is, we cannot say that these duties are true legal duties in the context of the current divorce law; therefore, its violation cannot cause civil liability. Afterward, we tried to analyze the issue from the perspective of the negative position and from the perspective of the responsible position, we concluded that although the positions of the two differ, in fact, they have the same purpose, that is, the individual's demand for more guarantee of the personality in marriage. Thus, we re-examined the reform in 2008, we tried to make an interpretation of article 1972 from a contemporary perspective, we believe that this reform aims to seek a new balance between freedom and guarantee. However, as we have seen, achieving this balance is difficult. Therefore, even if the law does not interfere in personal affairs, it must help the weak.
