Body Worn Cameras (BWC) are a mechanism recently adopted in Portugal, through Law nr 95/2021, of December 29th and Decree-Law nr 2/2023, of January 2nd, 2023.These were adopted with the aim of adapting the previous legislation to new technology used in other countries. According to the legislator, international experience demonstrates that the adoption of BWC has clear benefits in terms of reducing conflict in interventions and in the pursuit of criminal investigations, as it constitutes a relevant means of proof. Thus, it is important to understand the limits of using portable cameras for individual use. This work seeks to clearly define the use of these cameras: what they are, under which principles they can be used, who are the security forces that can use them and what impact this powerful instrument has on the rights, freedoms and guarantees of citizens. To this end, a more thorough understanding of the concepts used by this law is developed, along with a practical analysis of the circumstances in which the use of these cameras is “just allowed”, the situations in where the recording is mandatory and those in which it is prohibited.
