Neste sentido, o aumento da complexidade confronta o indivíduo com novos desafios e obriga o direito a um alargamento que acompanhe o desenvolvimento científico, bem como as mudanças nos usos e costumes. Com a evolução das técnicas médicas, designadamente as técnicas de diagnóstico préconcecional e pré-natal, é possível diagnosticar doenças congénitas antes da conceção e do nascimento de uma criança. Através do processo de aconselhamento genético, consegue-se tratar de problemas associados ao risco de uma patologia genética e identificar malformações de que o feto padeça. Quando o processo é efetuado defeituosamente o instituto da responsabilidade civil é chamado para responsabilizar o médico perante os pais e, até mesmo, perante a própria criança. Tais pretensões são designadas por wrongful actions – wrongful conception, wrongful birth e wrongful life – que pretendem responsabilizar os profissionais de saúde. É na pretensão de wrongful life que nos deparamos com uma importante consideração: a admissibilidade ou não da invocação do direito à não existência, bem como se as mesmas devem ser admitidas e, portanto, suscetíveis de indemnização.he scientific and technological progress has radically changed the world and society. As a result, the complexity increase makes people face new challenges and makes the law undergo an expansion which will enable it to follow the scientific development as well as the change in practices and traditions. With the evolution of medical techniques, specifically the preconception and prenatal diagnostic techniques, it is possible to diagnose congenital diseases before conception and before the birth of a child. Through the genetic counselling process it is possible to treat the problems associated with the risk of a genetic pathology and to identify the malformations the foetus may suffer from. When the process is wrongfully done, the civil liability institute is called upon to hold the doctor responsible before the parents and even before the child. Such claims are designated as wrongful actions – wrongful conception, wrongful birth and wrongful life – and they intend to hold the health care professional responsible.
