Résumé La recherche implique la notion de patrimoine dans les questions climatiques et l’équation entre les droits individuels et les droits communs de l’humanité dans le droit français. La méthodologie employée tente, à partir de la pensée de Foucauld, de situer le contexte dans lequel la crise environnementale est insérée et de décomposer les thèses juridiques environnementales concernant la protection des questions climatiques et des stratégies discursives qui marquent les contradictions entre les valeurs individuelles et collectives dans le système français. L’objectif est de vérifier l’utilisation du principe juridique de patrimoine de l’humanité dans la tutelle des questions climatiques. L’article part de l’hypothèse que la défense juridique du climat n’est possible que dans le cas d’une relativisation dans la maximisation des valeurs individuelles, fondamentale pour la réalisation du développement durable. Resumo A pesquisa envolve a noção de patrimônio nas questões climáticas e a equação entre os direitos individuais e os direitos comuns da humanidade no direito francês. A metodologia empregada tenta, a partir do pensamento de Foucuald, situar o contexto em que a crise ambiental está inserida e decompor as teses jurídicas ambientais acerca da proteção das questões climáticas e as estratégias discursivas que marcam as contradições entre os valores individuais e os coletivos no ordenamento francês. O objetivo é verificar a utilização do constructo jurídico de patrimônio da humanidade na tutela das questões climáticas. O artigo parte da hipótese de que a defesa jurídica do clima só é possível mediante uma relativização na maximização dos valores individuais, fundamental para a realização do desenvolvimento sustentável. Abstract: The research involves the notion of patrimony in climatic matters and the equation between individual rights and the common rights of humanity in French law. From the Foucuald 's perspective, the methodology employed tries to situate the context in which the environmental crisis is inserted and to decompose the environmental legal theses about the protection of climatic issues and the discursive strategies that mark the contradictions between individual and collective values in the French order. The objective is to verify the use of the legal construct of patrimony of humanity in the protection of the climatic issues. The article starts from the hypothesis that the legal defense of the climate is only possible through a relativization maximization of individual values, which is fundamental to the achievement of sustainable development.
