O dever estatal de incentivo ao voluntariado

It is incumbent upon the State to guarantee the constitutional rights of all citizens, namely those that are typically associated with a Welfare State such as the universal right to social security. It is beyond the scope of this work to explore why the State may not always guarantee such rights, leaving it up to charities and other non-governmental organizations to fill the void. A great number of this organizations place their reliance on volunteering activities to fulfil their purpose. It is necessarily up to the State, whether in line with the constitutional guarantees it assumes or following international guidelines, to create regulations, programmes, initiatives and mechanisms that establish favorable conditions for volunteering and for the protection of those who volunteer. Aiming to contribute to an understanding of how the Portuguese State fulfils this duty and how various entities perceive that role, this work was developed threw three key moments of investigation and data collecting, initially with a qualitative method and afterwards by a quantitative method. Throughout this work, confronting all the data collected both in documents and interviews to various relevant entities in the volunteering activity in Portugal, we will highlight the urgency to review de legislation in order to tune the law with the practical necessities of the promoters of volunteering, creating conditions to revitalize and take advantage of the existing structures, meeting the needs mentioned by interviewees.
