Through the intricacies of a refuge that does not protect: Analysis of international and portuguese normative guidelines that regulate international protection

Resumo: Due to multiple crises, conflicts and political, social, economic, among other changes, many people flee the countries where they are to seek protection in another country. Arriving at international borders, they are faced with various barriers and limits, when faced with the right to leave a country, but not to enter third countries, even to ask for protection. Because of the difficulty in managing migratory movements, the international and european asylum system is being reformed, but not all countries want to participate in or protect these people. While the new recommendations uphold the importance of defending the human rights of all migrants, applicants for protection are detained, deported and unprotected. Portugal is governed by european normative guidelines, and is also reforming its asylum system, which is in clear rupture. This article is part of a PhD research in Educational Sciences and, using document analysis, it is intended to critically analyze the international, european and portuguese guidelines that regulate access to protection, and reports and studies that show how these guidelines are applied and what their effects are. The period under review will be from 2019, when the new recommendations promoted by the UN were approved by the EU and began to be put into practice, to July 2023. This analysis will also mention the importance of the right to education, so that, through an awareness development process, applicants and beneficiaries of protection have full access to all other human rights.

Chegadas a fronteiras internacionais, deparam-se com diversas barreiras e limites, ao serem confrontados com o direito de abandonar um país, mas não de entrar em países terceiros, mesmo para pedir proteção. Pela dificuldade em gerir os movimentos migratórios, o sistema de asilo internacional e europeu está a ser reformado, mas nem todos os países querem participar ou proteger estas pessoas. Embora as novas recomendações defendam a importância da defesa dos direitos humanos de todos os migrantes, requerentes de proteção são detidos, deportados e desprotegidos. Portugal rege-se pelas orientações normativas europeias, e também está a reformar o seu sistema de asilo, que se encontra em clara rotura. O presente artigo insere-se numa investigação de doutoramento em Ciências da Educação e, com recurso à análise documental, pretende-se analisar criticamente as diretrizes internacionais, europeias e portuguesas que regulam o acesso à proteção, e relatórios e estudos que mostram como estas orientações são aplicadas e quais os seus efeitos. O período em análise será entre 2019, quando as novas recomendações promovidas pela ONU foram aprovadas pela UE e começaram a ser colocadas em prática, e julho de 2023.
