While the right to strike is closely linked to the fundamental social rights of workers, fundamental freedoms represent pure economic freedoms aimed at expanding the economy and maximizing capital. For a better understanding of this problem, we will start by following the evolution of the Union's social policies, and then proceed to analyze the diplomas that establish the right to strike in the European legal system, namely: the European Social Charter, the Charter of Fundamental Rights of the European Union, the European Convention on Human Rights, and the Community Charter of Fundamental Social Rights of Workers. Finally, it is essential to study the application of the rules contained in these diplomas in the practical life, since, although the strike is excluded from matters of Union legislative intervention, the Court of Justice of the European Union and the European Court of the Human Rights have been confronted with issues related to the topic and to which they must respond. To this end, this dissertation will critically analyze the main judgments given by them, namely: the Viking Line and Laval judgments, delivered by the Court of Justice, and the Maritime and Transport Workers judgment against the United Kingdom, delivered by the Court European Convention on Human Rights. These judgments are presented as a fundamental foundation for the creation or understanding of the frameworks in which the right to strike is admitted within the legal system of the Union, and have tried to give and answer the problem of the connection between the exercise of fundamental freedoms and rights fundamental social rights of workers.Esta dissertação propõe-se ao estudo e compreensão dos moldes em que o direito à greve é consagrado no seio do ordenamento jurídico europeu, ao mesmo tempo que tenta compreender a articulação entre o exercício deste direito e o exercício das liberdades fundamentais da União, uma vez que ambas representam polos opostos. Enquanto a greve se encontra intimamente ligada com os direitos sociais fundamentais dos trabalhadores, as liberdades fundamentais representam puras liberdades económicas que têm em vista a expansão da economia e a maximização do capital. Para uma melhor compreensão desta problemática iremos começar por acompanhar a evolução das políticas sociais da União, e seguidamente prosseguir à análise dos diplomas que consagram o direito à greve no ordenamento jurídico europeu, a saber: a Carta Social Europeia, a Carta dos Direitos Fundamentais da União Europeia, a Convenção Europeia dos Direitos do Homem, e a Carta Comunitária dos Direitos Sociais Fundamentais dos Trabalhadores. Por fim, afigura-se essencial o estudo da aplicação das normas contidas nestes diplomas, na vida prática, uma vez que, embora a greve se encontre excluída das matérias de intervenção legislativa da União, o Tribunal de Justiça da União Europeia e o Tribunal Europeu dos Direitos do Homem têm sido confrontados com problemáticas relacionadas com o tema e às quais devem dar uma resposta. Para tal, esta dissertação irá analisar de uma forma critica, os principais acórdãos por estes proferidos, a saber: os acórdãos Viking Line e Laval, proferidos pelo Tribunal de Justiça, e o acórdão Maritime and Transport Workers contra o Reino Unido, proferido pelo Tribunal Europeu dos Direitos do Homem.
