Resumo: Social tolerance towards domestic violence, a transversal issue across societies, has declined significantly in recent times grounded on long discussions. The Portuguese legislator has demonstrated a growing concern about the phenomenon of domestic violence: by expanding the protection of the victims and focusing on measures to prevent and eradicate this crime. However, domestic violence remains a current and relevant public phenomenon, with personal and social consequences, which deserves to be exhaustively studied, as this unlawful act affects the entire society. The crime of domestic violence may materialise itself in different (...). descausing problems of heterogeneous (...) of crimes of domestic violence. However, in the judicial practice, the judge has consistently sentenced the offender to a single crime of domestic violence. The judge m y (...) domestic violence. The justice does not distinguish situations where there is repetition of mistreatment from a single especially onerous act or several especially grievous isolated acts of mistreatment, spaced in time or numerous separable reiteration from each other. The offender is always punished for one single crime, independently of having repeatedly maltreated the victim or having performed a single particularly serious act. For this reason, and for reasons of material justice, it is imperative to analyse the crime of domestic violence and the possibility of the offender being sentenced for a plurality of crimes of domestic violence. This is the reality we intend to study. The aim of this paper is to find (...) domestic violence. The phenomenon of domestic violence is in fact an old problem that demands new answers. This dissertation will seek to establish some of those answers.

This dissertation will seek to establish some of those answers.Tem sido com base em longas discussões que a tolerância social face à violência doméstica, um problema transversal às sociedades, tem diminuído significativamente nos últimos tempos. O legislador português tem vindo a demonstrar uma crescente preocupação com o fenómeno da violência doméstica, ampliando a proteção das vítimas, apostando em medidas de prevenção e erradicação deste crime. Contudo, a violência doméstica continua a ser um fenómeno atual e de relevância pública, com consequências pessoais e sociais graves, que merece ser minuciosamente estudado, pois atinge toda a sociedade. O crime da violência doméstica pode materializar-se em diferentes crimes, suscitando a questão do concurso de normas, o concurso aparente de crimes. Além de originar também problemas de concurso heterogéneo, coloca igualmente, em nosso entender, a questão do concurso homogéneo. Ou seja, levanta-se a problemática da unidade ou pluralidade de crimes. No entanto, na prática jurisdicional, o juiz tem condenado o agente ativo, invariavelmente, por um único crime de violência doméstica. Simplesmente não considera a possibilidade do concurso homogéneo no âmbito deste crime, não distinguindo as situações em que há reiteração dos maus tratos daquelas em que há apenas um ato isolado especialmente gravoso, ou vários atos isolados especialmente gravosos e temporalmente separados, ou várias reiterações autonomizáveis umas das outras. O agente do crime é sempre punido por um só crime, quer tenha reiteradamente praticado maus tratos, ou apenas um ato isolado especialmente gravoso. Deste modo, e por razões de justiça material, torna-se imperioso analisar o crime de violência doméstica e a possibilidade de o infrator ser condenado por uma pluralidade de crimes de violência doméstica.
