Domestic Violence, as a phenomenon that has to be stopped, given the repercussions for the victims and the whole society, remains a current topic, with new crimes emerging every day. The crime of domestic violence can be filled by conduct that would already be typical in light of other legal types, whether they are more or less seriously punished. Therefore, this crime raises sensitive problems of crime “concursus”: real/effective or apparent, heterogeneous or homogeneous. Having analysed the judicial practice, we verified that the homogeneous effective "concursus" is disregarded in the crime of domestic violence, resulting in a benefit of the offender and, consequently, a decrease in the victim's protection and protection of the legal interest. This is the problem under analysis, identifying its causes, as well as some possible ways and solutions, through the critical analysis of judicial practice.
