Analisaremos as correntes abolicionistas, minimalistas e meio de justiça restaurativa em busca de razões que justifique ou não a necessidade de um direito penal forte e repressivo.Em se tratando de abolicionismo penal, teoria essa derivada da criminologia crítica, o presente trabalho se limitará a demonstrar as visões dos criminólogos Louk Hulsman e Nils Christie, analisando o entendimento no sentido da inutilidade do direito penal.Já na vertente do minimalismo penal, buscar-se-á falar sobre as teorias apresentadas pelos juristas Alessandro Baratta e Luigi Ferrajoli, compreendendo como os autores buscam legitimar o Direito Penal diferentemente da perspectiva abolicionista. Desmontando ainda a visão do direito penal de forma legitimadora do estado de direito. Para além, como forma de incrementar o estudo, far-se-á breves considerações acerca da justiça restaurativa, analisando assim um contraponto ou um meio termo entre as duas linhas de pensamento.O primeiro capítulo propõe uma evolução histórica acerca do sistema penal, da pena e da evolução da pena de prisão, bem como os movimentos criminológicos que colaboraram para a manutenção de um sistema punitivo; O segundo capítulo dedica-se a tratar do abolicionismo penal, de forma a apresentar seu conceito, objetivo, evolução, bem como o abolicionismo na visão de Louk Hulsman e Nils Christie; O terceiro apresenta os modelos minimalistas de Alessandro Baratta e Luigi Ferrajoli, como mencionados anteriormente e no quarto e último capítulo, para finalizar, teceremos breves considerações acerca da justiça restaurativa, na tentativa de apresentar um elo entre a propostas abolicionista e minimalistaThe present work has as proposal to present the criminal abolitionism, the penal minimalism and the restorative justice. we will seek to understand what is wrong with criminal law, against the punitive power of states and their effective application. We will analyze the abolitionist, minimalist currents and means of restorative justice in search of reasons that justify or not the need for a strong and repressive criminal law.In the case of criminal abolitionism, this theory is derived from critical criminology, the present work will confine itself to showing the views of criminologists Louk Hulsman and Nils Christie, analyzing the understanding of the meaninglessness of criminal law.In the area of penal minimalism, we will try to talk about the theories presented by jurists Alessandro Baratta and Luigi Ferrajoli, understanding how the authors seek to legitimize Criminal Law differently from the abolitionist perspective. Dismantling the vision of criminal law in a way that legitimates the rule of law.
