The article concerns the incommensurability of discourses. It proceeds from the present-day context marked by economic and financial discourses, debt-related narratives, and states of financial exception. Within this framework, characterized by discourses around financial crises, debt ceilings, or the difficulties of financing the welfare state, the analysis focuses particularly on the incommensurability of the discourses of economists (some economists) and lawyers (some lawyers) around the issues raised by the austerity policies of various countries within the European Union. The confrontation of discursive narratives leads to an unavoidable reflective halt concerning the sources of the law in inter-normative legal systems, and entails a reflection about the intertwined hierarchies between norms – rules and principles – unfolding in the normative scenario of the constitutional democratic state and ‘governance decisions’ precipitated by the need to tackle urgent collective problems (excessive indebtedness, policies of fiscal devaluation).
