Trocou-se um conjunto de regras de maior pendor paternalista por outro que, dando expressão a tendências atuais (também manifestadas, por exemplo, através da consagração legislativa do testamento vital ou da procuração de cuidados de saúde), se inclina abertamente ante a soberania individual. É, sobretudo, da sua descrição e fundamentação que aqui se trata.With the implementation of the Law no. 49/2018, of August 14, which introduced changes in various statutes, but mainly in the Civil Code, the institutes of interdição/inabilitação were abolished. They were replaced by the socalled supported decision-making on behalf of adults. A set of more paternalistic rules has been exchanged for another which, by giving expression to current tendencies (also manifested, for example, through the legislative recognition of the living will or the health care proxy), openly bows to individual sovereignty.
