Este tipo de mau trato insere-se no mau trato passivo e acontece quando os adultos falham, por omissão, os cuidados que a criança necessita para crescer, podendo pôr em causa o seu desenvolvimento salutar. A intervenção judicial em casos de crianças vítimas de maus tratos tem por objetivo a promoção e proteção de crianças e jovens e acontece quando os pais, o representante legal ou quem tenha a guarda de facto ponham em perigo a sua segurança, saúde, formação, educação ou desenvolvimento. Neste seguimento, é cada vez mais frequente vermos crianças a serem inquiridas em sede de tribunal. Contudo, vários estudos têm demonstrado que a terminologia legal utilizada é muitas vezes incompreensível para as crianças que, ademais, não compreendem os processos legais nos quais estão envolvidos. Neste sentido e face à ausência de estudos em Portugal sobre este tema, a presente investigação tem como objetivo geral perceber quais as perceções que as crianças têm da justiça portuguesa, através das significações e dos sentidos que as mesmas atribuem a determinados termos legais. Este trabalho encontra-se dividido em três grandes áreas. A interpretação dos dados recolhidos nas entrevistas regeu-se pelos pressupostos da metodologia qualitativa, utilizando os critérios de categorização da análise de conteúdo. Por sua vez, e com o objetivo de trabalhar as variáveis sociodemográficas e auferir se a idade, o género e o contacto com a justiça influenciam conhecimento e as representações que as crianças têm da justiça portuguesa, recorreu-se à metodologia quantitativa. Foram realizadas 17 entrevistas estruturadas a crianças com idades compreendidas entre os 6 e os 12 anos, das quais 11 já tiveram contacto com o dispositivo jurídico e as restantes 6 nunca tiveram qualquer tipo de contacto. Os resultados do presente estudo mostram que, de forma geral, as crianças têm uma representação negativa da justiça, que os papéis dos profissionais da área jurídica são raramente descritos corretamente, que não se verificam diferenças significativas em função do sexo, da idade e do contacto. Assim, podemos concluir que, crianças que têm um contacto mais próximo com os tribunais não têm mais conhecimento sobre o mesmo, comparativamente a crianças sem qualquer tipo de contacto com o sistema judicial.One of the main reasons for promoting and protecting children and youth at risk is negligence. Negligence consists of chronic privation of the basic necessities of hygiene, nutrition, affection, education, health, and child vigilance. It is a passive maltreatment and occurs when adults fail, by omission, to provide the care necessary for the child’s growth. Consequently, this can put the child’s healthy development at risk. The purpose of judicial intervention in cases of maltreated children and youth is to promote and protect children and youth. Intervention happens when the parents, legal representative, or whoever has custody of the child has endangered their health, safety, training, education, or development. It is becoming more and more frequent to see children being interviewed in court. However, several studies have shown that the legal terminology used in court is often incomprehensible to children who, in addition, do not even understand the legal processes they are involved in. In this regard, and due to the lack of studies in Portugal on this topic, the general objective of this investigation is to understand what perceptions children have of the Portuguese justice system through the definitions and meanings they attach to certain legal terms. The work has been divided into 3 main areas. The interpretation of the results collected through interviews follows the principles of the qualitative methodology and it is used the categorization criteria of content analysis. The quantitative methodology was used in order to realize the influence of social demographic variables and try to understand if age, gender and the contact with the justice influence the knowledge and the interpretations that the children have about Portuguese justice. In this way, 17 structured interviews were realised with children with the age between 6 and 12 years old. One group is composed per 11 children who already had contact with the justice and another group per 6 children who never had this kind of contact. Interpretation of the data collected in the interviews was governed by the principles of qualitative methodology using the criteria for categorization of content analysis. The qualitative methodology was used with the objective of working the various social demographic variables to derive whether age, gender, and contact with justice influences the knowledge and representations that children have of the justice system. Structured interviews were had with 17 children with ages ranging between 6 and 12. From this group, 11 children had already had contact with the justice system and 6 children had never had any type of contact with the justice system. The results of the present study show generally that: children have a negative representation of justice; the roles of the different juridical professionals are rarely described correctly; there were no significant differences in terms of gender, age, or previous contact with justice.
