É a estas perguntas que o presente trabalho pretende dar respostas.O trabalho divide-se em três capítulos iniciando com uma contextualização histórica da evolução do Mercado Arrendamento em Portugal até ao aparecimento do NRAU e, em particular, da alteração introduzida com a Lei nº31/2012 com destaque para as principais alterações que esta lei implementou no quadro legal do arrendamento. O segundo capítulo define o conceito de Procedimento Especial de Despejo e descreve sumariamente a sua tramitação. E o terceiro capitulo vai focar os "pontos críticos", os aspetos menos conseguidos do Procedimento Especial de Despejo e avaliar de que forma é que os mesmos podem afetar direitos fundamentais do arrendatário. Ainda, na parte final deste capítulo há espaço e oportunidade para realçar, partindo dos pontos fracos, as virtualidades do Procedimento Especial de Despejo concluindo por uma análise reflexiva sobre a viabilidade futura deste procedimento e apontando algumas notas de melhoria para reforçar a robustez constitucional do Procedimento Especial de Despejo.The special eviction procedure is an innovation instituted by the law No. 31/2012 of August 14 which introduced profound changes in the new urban Lease Regime.It is characterized to be extrajudicial in nature, with a hybrid basis (Declarative and Executive) processed in accordance with the National Lease Desk.The main aim is to allow the quickly and effective eviction of the building if the terms of the contract were broken by the lessee.Does an out-of-court or extrajudicial procedure, quickly and flexible, not limit the fundamental rights of the lessee, such as the right of having a house, the right to defence or the right to justice?It is to these questions that this paper intends to provide answers.The work is divided into three chapters starting with a historical contextualization of the evolution of the Lease in Portugal until the emergence of the NRAU and, in particular, the amendment to law No. 31/2012 highlighting the main changes this law implemented in the legal framework of the lease.The second chapter defines the concept of Special Procedure of eviction and describes briefly its processing.The third chapter will focus on the "critical points", the less successful aspects of the special Eviction Procedure and assess how they may affect fundamental rights of lessee.At the end of this chapter there were opportunity to highlight, through the weaknesses, the virtues of the Special Procedure of Eviction.
