Primeiramente, teceremos algumas considerações introdutórias sobre os crimes sexuais e a evolução legislativa do crime de lenocínio até aos dias de hoje. Posteriormente, dedicaremos algum tempo a analisar o regime atual do crime de lenocínio simples, fazendo uma observação crítica ao tipificado pelo legislador. Feito o estudo aprofundado do 169.º, n.º 1 do CP, recorreremos à doutrina e à jurisprudência para analisar o bem jurídico tutelado, por se tratar de um elemento de grande destaque da dissertação. Será igualmente feita um breve referência ao crime de lenocínio de menores (175.º do CP) e ao lenocínio agravado (169.º, n.º 2 do CP). De seguida, procederemos à análise do fenómeno da prostituição em Portugal e em outros ordenamentos jurídicos. Para delimitar o crime de lenocínio será feita uma pequena referência ao crime de tráfico de pessoas (art.º 160, n.º 1 do CP). Por último, e com o intuito de apurarmos se a incriminação contida no 169.º, n.º 1 do CP tem ou não legitimidade constitucional, evocaremos os preceitos e exigências constitucionais (artigo 18.º, n.º 2 da Constituição da República Portuguesa). Tudo isto com o propósito de responder com clareza ao seguinte: o artigo 169.º, n.º 1 do Código Penal tutela o bem jurídico da liberdade sexual?A investigação que iremos apresentar debruça-se sobre o crime de lenocínio, mais concretamente o artigo 169.º, n.º 1 do Código Penal, que prevê o tipo legal de crime de lenocínio simples. Finished the depth study of the art. 169.º, n.º 1 of the CP, we will resort to doctrine and jurisprudence to analyze the “legal good” because it is the major element of the dissertation.A brief reference will also be made to the crime of pimping of minors (art.º 175.º of the CP) and the crime of pimping qualified (169.º, n.º 2 of the CP).Then, we will analyze the phenomenon of prostitution in Portugal and in other legal systems around Europe. To delimit the crime of pimping, a small reference will be made to the crime of trafficking people (article 160.º, n,.º 1 of the CP).With the purpose of determine whether the incrimination contained in the art.º 169., n.º 1 of the CP has constitutional legitimacy or not, we will evoke the constitutional principles (art.º 18.º, n.º 2 of the Portuguese Constitution).
