Resumo: | The subject of this article is the sui generis right granted to producers of databases, provided for in the Directive 96/9/EC of the European Parliament and of the Council of 11 March 1996 on the legal protection of databases, transposed in Portugal by the Legislative Decree no. 122/2000, of July 4. After taking a glance to the aim of providing this intellectual property right, this article analyses the notion of database, the subject matter of protection, the requirements for protection and the scope of the right. During this exercise, interpretation of some vague concepts such as substantial investment, obtaining, verification or presentation, extraction, re-utilization, amongst others, are presented. |

O objeto deste artigo é o direito sui generis concedido aos produtores de bases de dados, previsto na Diretiva 96/9/CE do Parlamento Europeu e do Conselho, de 11 de março de 1996, relativa à proteção jurídica das bases de dados, transposta em Portugal pelo Decreto Legislativo n.º 122/2000, de 4 de julho. Depois de olhar para o objetivo de fornecer esse direito de propriedade intelectual, este artigo analisa a noção de banco de dados, o objeto da proteção, os requisitos de proteção e o alcance do direito.
