Mais do que um mero jogo, este assume-se como uma tecnologia em crescente expansão e que ambiciona uma verdadeira transcendência a um plano de vivências que será, o mais puramente possível, digital. Em caso de plena consolidação deste ideal de ultrapassagem (ou, no mínimo, de equiparação) do mundo “dos píxeis” face ao “dos átomos”, as alterações sociais serão vastas. Consequentemente, suscitar-se-ão problemáticas também elas diversas, relacionadas com os diferentes domínios de atuação de um metaverso. Nomeadamente, dada a natureza do espaço digital como potencialmente “vigilante” dos seus utilizadores, e dado o grau de imersão e superação prometido por esta nova era digital, apontam-se importantes questões relativas à privacidade e à proteção de dados gerados e processados neste contexto. De modo particular, devido à natureza sensível de uma prestação de cuidados em causa e do conteúdo das informações respeitantes à condição bioquímica e emocional da pessoa, tem especial interesse problematizar a questão dos dados de saúde em matéria de little e big data, e a maneira como esta se relacionará com a proteção da reserva da intimidade da vida privada e demais derivações de uma análise de um right to privacy. Embora de relativa contemporaneidade e sem beneficiar de uma intensa produção científica, jurisprudencial e normativa que atenda suficientemente às suas especificidades, entendemos que, face aos riscos inerentes a uma hipotética vulgarização de um conceito de metaverso, este deverá ser objeto de maiores estudos pela literatura, e regulamentações que permitam mitigar de forma satisfatória as preocupações apontadas em matéria de dados pessoais.At times, fiction will have a direct physical impact on reality: a clear example of such concept is the so-called metaverse, a complex idea by design that has been attracting great interest in the last couple of decades. More than a game, the metaverse presents itself as an ever-expanding technology, whose ultimate goal is a, as perfect as possible, transcendence to life in a digital realm. In the case of a true establishment of this scenario of the overcoming (or, at the very least, equivalence) of the material, “atom” world, into a “pixelated” one, social changes will be intense. Thus, a plethora of problems will likewise arise, regarding the many fields of action present in a metaverse. Among others, given the nature of the digital space as potentially tracking of its users, and considering the levels of immersion and physical surpassing aimed by this new digital era, important questions related to one’s privacy and data protection in this particular context are presented. In particular, taking into account the sensitive nature of the provision of healthcare and the nature of information related to the biochemical and emotional status of the individual, there’s a particular interest in problematizing the treatment and collection of healthcare data, both “little” and “big”, and how they will relate to the protection of one’s intimate life and other considerations brought by an analysis of a right to privacy.
