Resumo: This thesis arose from the need to publicize the importance of the mediation process in a democratic society that must provide its citizens with efficient conflict resolution processes. Thus, having as basic principles they need to create faster, less expensive, more satisfactory ways that preserve the good relationship and the international rules of etiquette between the parties, this dissertation proposes to present the alternative dispute resolution to settle international altercations, through the mediation of conflicts, as opposed to the traditional jurisdictional resolution. Mediation is a new legal approach and management tool to deal effectively with international trade disputes, recognized by the United Nations and the Commission on International Trade Law, which, noting that there was a gap in legal certainty due to the lack of mechanisms that ensured the execution of the mediation agreements, when necessary, began work that culminated in the United Nations Convention on International Mediation Agreements, better known as the Singapore Convention, which will be the object of study. That being said, it is important to define how the dissertation will be structured. The first part is aimed at framing the theme of alternative conflict resolution and the emergence and rise of mediation, not only in the international but also in the national sphere. Furthermore, it is worth mentioning its benefits and characteristics. Next, an analysis of the Convention and its main characteristics is essential and more importantly, define its scope of application so that in this way it is possible to conclude which cases benefit from its application. There follows a chapter dedicated to exploring its benefits for international trade, using not only theory. Regarding the third chapter, I will be analyzing why Portugal did not adhere to the Convention while critically examining the reasons that might justify such a decision, balancing its possible advantages and disadvantages. Finally, we will reach the conclusions of this research, seeking to answer the following questions: why and when do we benefit from the use of mediation in international commercial disputes? What is the scope of application of the Singapore Convention? Should the Portuguese State consider becoming a party in this Convention?

Should the Portuguese State consider becoming a party in this Convention?A presente tese surgiu da necessidade de divulgar a importância da mediação numa sociedade democrática que deve disponibilizar aos seus cidadãos processos de resolução de conflitos eficientes. Assim, tendo como princípio basilar a necessidade de criar formas mais céleres, menos dispendiosas, mais satisfatórias e que preservem a boa relação e as regras de etiqueta internacional entre as partes, esta dissertação propõe-se apresentar a mediação como forma de dirimir as altercações internacionais, em contraposição à resolução jurisdicional ou arbitral. A mediação é uma nova abordagem jurídica e uma ferramenta de gestão para lidar com conflitos comerciais internacionais eficazmente, sendo tal reconhecido pelas Nações Unidas e pela Comissão para o Direito Comercial Internacional, que, constatando que havia uma lacuna na segurança jurídica devido à falta de mecanismos que garantissem a execução dos acordos de mediação quando necessário, iniciaram trabalhos que culminaram com a Convenção das Nações Unidas sobre Acordos de Mediação Internacionais, mais conhecida como Convenção de Singapura, que será o objeto de estudo. Posto isto, importa definir como é que a dissertação será estruturada. Uma primeira parte destina-se ao enquadramento do tema da resolução alternativa de conflitos e do surgimento e ascensão da mediação no âmbito internacional e nacional. Para mais, cabe uma breve alusão aos benefícios e características desta. De seguida, é impreterível uma análise da Convenção e das suas principais características e, mais importante ainda, definir o seu âmbito de aplicação para que desta maneira seja possível concluir quais os casos que beneficiam da aplicação desta. Segue-se um capítulo dedicado a explorar os benefícios desta para o comércio internacional, recorrendo-se para o efeito não só à teoria. No que concerne ao terceiro capítulo, examinar-se-á criticamente o facto de Portugal não ter aderido à Convenção e investigar-se-á os motivos que poderão justificar tal decisão, contrabalançando as suas possíveis vantagens e desvantagens. Por fim, chegaremos às conclusões desta pesquisa, procurando responder às seguintes questões: porquê e quando é que beneficiamos com o recurso à mediação, aquando de disputas comerciais internacionais? Qual é o escopo de aplicação da Convenção de Singapura?
